At Zashin & Rich, we recognize the intense and inherently complex issues that often surround determinations of child custody. Furthermore, with the growing mobility of our country’s population and the uncertainty in today’s global environment, we are acutely aware that nothing can be more frightening or complicated than facing an international custody dispute over your children.

Although far from being new phenomena, the increasing frequency of international relocation and the globalization of today’s world present unique challenges when it comes to the already complicated area of child custody litigation. Our attorneys are experienced in dealing with the countless delicate considerations that must be made in such proceedings, including the 1961 and 1980 Hague Conventions regarding the protection of minors and international child abduction.  While the Conventions are only one piece of an intricate puzzle, they impart many potential opportunities — as well as obstacles — to a successful resolution of an international dispute.  Among the most common of these issues are disagreements over the “habitual residence” of children, not to mention the “Zone of War” or “grave risk of harm” exception to the prompt return of wrongfully removed children, to name but a few.
